1. Agreement to Terms

By accessing or using the Delphian platform ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Delphian Ltd ("Delphian", "we", "us", or "our"), a company registered in Ireland.

2. Account Eligibility

The Service operates on an invite-only basis. Access is restricted to users whose email addresses have been pre-approved by Delphian. You may not create an account unless your email has been added to our allowlist.

By creating an account, you represent that:

  • You are at least 18 years of age
  • The information you provide is accurate and complete
  • You will maintain the security of your account credentials
  • You will promptly notify us of any unauthorised use of your account

You are responsible for all activity that occurs under your account.

3. Description of Service

Delphian provides an EU legislative monitoring platform that aggregates publicly available information from EU institutions, including:

  • Legislative procedure tracking (European Parliament, Council, Commission)
  • Committee meeting agendas, documents, and transcripts
  • Signal feeds from institutional RSS sources and official publications
  • AI-generated briefings and summaries powered by Google Gemini
  • Calendar views of institutional meetings and events
  • MEP activity profiles and voting records

The Service presents information sourced from official EU institutional feeds and public records. While we strive for accuracy, we do not guarantee the completeness, timeliness, or accuracy of all data. The Service is provided for informational purposes only and does not constitute legal, political, or professional advice.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Interfere with or disrupt the Service or the servers and networks connected to it
  • Scrape, crawl, or use automated means to extract data from the Service beyond normal use
  • Share your account credentials with any third party
  • Redistribute, resell, or sublicense the Service or its content without prior written consent
  • Remove or alter any proprietary notices or branding from the Service

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Intellectual Property

The Delphian platform, including its design, code, user interface, and AI-generated content, is the intellectual property of Delphian Ltd and is protected by applicable copyright and other intellectual property laws.

Source data from EU institutions (legislative texts, meeting agendas, public documents) remains subject to the respective institutions' terms and reuse policies, including the European Commission's reuse policy and the European Parliament's open data terms.

Your use of the Service does not grant you ownership of any content, data, or intellectual property made available through the platform.

6. Service Availability

We aim to provide the Service on a continuous basis but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance or updates
  • Unplanned outages of third-party infrastructure (Firebase, Vercel, upstream EU feeds)
  • Force majeure events beyond our reasonable control

We will make reasonable efforts to notify users in advance of planned downtime. We are not liable for any loss or inconvenience arising from service interruptions.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Delphian shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total aggregate liability for any claim arising from or relating to the Service shall not exceed EUR 100 (one hundred euros).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or personal injury caused by negligence.

8. Account Termination

You may request deletion of your account at any time by contacting us at legal@delphian.eu or through your account settings.

We may suspend or terminate your account if:

  • You breach these Terms
  • Your email is removed from the approved allowlist
  • We are required to do so by law
  • The Service is discontinued

Upon termination, your personal data will be handled in accordance with our Privacy Policy. Account data is retained for 30 days after deletion to allow recovery, after which it is permanently erased.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before they take effect.

Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and request account deletion.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland. Nothing in these Terms affects your rights as a consumer under mandatory provisions of the law of your country of residence.
